Member Agreement

INTRODUCTION

This Membership Agreement sets forth the terms and conditions in which a registered member may use the Service, and the way in which the PRETTY BRIDES (“the Company”, "us") will provide and offer the Service. 

Please read this Membership Agreement carefully before registering yourself to become a member. You will be required to accept the terms and conditions set forth herein in order to become a member. 

THE SERVICE

The term “Service” includes all functionality made available by the Company on or through the website www.prettybridescollection.com (“the Site”). PRETTY BRIDES may add to, delete from, or modify the Service at any time. 

MODIFICATIONS/ CHANGES TO AGREEMENT AND SERVICE

PRETTY BRIDES may change the Membership Agreement or the terms and conditions set forth herein from time to time with or without notice at the Company's absolute discretion. Your continued access or use of the Service provided herein subsequent to any such change will be deemed as your acceptance to those changes. 

PRETTY BRIDES may discontinue or revise any or all other aspects of the Service at its sole discretion and without prior notice. 

MEMBERSHIP

To register as a member of the Service, you must be:

1. 18 years or over;
2. a Master Card or Visa Card holder; 
3. a Malaysian or Singaporean registered mobile phone holder

In order to use the Service, you must first register as either a EXZA TRADE ENTERPRISE VIP Member or a EXZA TRADE ENTERPRISE Free Member. 

PRETTY BRIDES Free Member

Upon successful registration as a PRETTY BRIDES Free Member, you will be notified through e-mail and/or via notice through the Site. No membership fee is imposed on a PRETTY BRIDES Free Member. 

As a PRETTY BRIDES Free Member, your membership entitles you to limited access to the Service offered through the Site. Your use of the Service as a PRETTY BRIDES Free Member is only limited to place order and submit enquiry. PRETTY BRIDES shall not warrant nor be responsible for the security of your data, or such other information stored (whether temporarily or otherwise) in the user account. You agree that you post, send, transmit, store or otherwise publish all such data, and information strictly at your own risk and the Company shall not be liable to you for any loss or damage that you may suffer resulting therefrom. 

Member Responsibilities

You agree that the information that you provide to PRETTY BRIDES on registration and at all other times is true, accurate, current, and complete. You also agree that you will ensure that this information is kept accurate and up to date at all times. This is especially important with respect to your email address. 

As you are responsible for all activities that occur under your password and/or username, you agree to keep your password and/or username confidential. You must immediately notify PRETTY BRIDES of any unauthorized use of your password and/or username any other breach of security in relation to the Service. However, because user authentication on the Internet is difficult, PRETTY BRIDES cannot and does not confirm that each user is who they claim to be. Therefore, the Company is not responsible for any unwarranted access to your user account or for misuse of your user account as a result of such unwarranted access. The Company reserves the right to require you to alter your password and/or username if EXZA TRADE ENTERPRISE believes that the security of the Service is breached or potentially breached. 

Each individual is allowed to have only one membership, Membership is intended for personal use only and is non-transferable. EXZA TRADE ENTERPRISE reserves the right to delete multiple accounts at EXZA TRADE ENTERPRISE's sole discretion and without notice. Use of multiple passwords or other methods to create multiple accounts is prohibited. 

AVAILABILITY OF THE SERVICE

EXZA TRADE ENTERPRISE will use reasonable endeavours to ensure that the Service made available to you is free from interruptions, disruptions, failures or any other technical problems. However, there will be occasions when the Service will be interrupted for maintenance, upgrades and emergency repaires or due to failure of telecommunications links and equipment or such other events that are beyond the control of EXZA TRADE ENTERPRISE. Every reasonable step will be taken by EXZA TRADE ENTERPRISE to minimize such disruption where it is within the reasonable control of EXZA TRADE ENTERPRISE. You agree that EXZA TRADE ENTERPRISE is not and cannot be liable to you in any way for such interruptions, disruptions, failures or any other technical problems relating to the Service. 

E-MAIL

We will communicate with you via email. EXZA TRADE ENTERPRISE may send regulare email updates and occasional promotional offers that may be of interest to you. You may opt-out of these mailings at any time upon receipt. 

RIGHTS OF EXZA TRADE ENTERPRISE

Online Account
EXZA TRADE ENTERPRISE reserves the rights to terminate access to your user account or delete the images stored on your account if you post, send, transmit, upload, or otherwise publish any data, image, photo, file, text or any other content or material that:is or might be perceived by EXZA TRADE ENTERPRISE or EXZA TRADE ENTERPRISE's members or users, as defamatory, libelous, disparaging, obscene, pornographic, profane, threatening, abusive, deceptive, offensive, vulgar, ethnically offensive, objectionable or inappropriate, including nudity, adult content, illegal content, content of a sexual nature, or otherwise objectionable;contains or displays any expression of bigotry, racism, or hatred, or is ethnically offensive, objectionable or inappropriate;interferes with anyone else's use of this Site and/or Service; 

Processing of Purchases
EXZA TRADE ENTERPRISE reserves the right to reject, refuse or decline to process, perform or deliver any of your purchases that is or in EXZA TRADE ENTERPRISE's opinion as defamatory, libelous, obscene, pornographic, illicit or otherwise offensive in nature. Subject to any administrative expenses that may be charge to your account, EXZA TRADE ENTERPRISE shall endeavour to refund the payments made for such purchases to you by crediting your account. 

PURCHASES, PAYMENT AND DELIVERY ISSUES

Purchase of Services and Products
You are given the option to acquire the Service through the www.prettybridescollection.com of your choice. You are to select your Processing of your purchases is subject to payment being successfully charged from your credit card. 

Suspension and Termination of Service and Membership

If you object to any portion of this Membership Agreement, or any subsequent modification thereto, or become dissatisfied with the Service, the Site, or any materials, data, text, images, or any transaction entered into through the Site or Service, your only recource is to immediately discontinue use of the Service and notify EXZA TRADE ENTERPRISE of such termination in writing. EXZA TRADE ENTERPRISE reserves the right, in its sole discretion to terminate all or a portion of the Service at any time and for any reason. Any termination under any provision of this Membership Agreement may be effected without prior notice, and EXZA TRADE ENTERPRISE will immediately delete and discard your user account and/or bar any further access to such files on the Site or through the Service. Upon any termination of your Membership, or of this Membership Agreement, your right to use the Service will immediately cease. EXZA TRADE ENTERPRISE will have no obligation thereafter to host or provide access to your user account, or to forward any materials stored through the Service. EXZA TRADE ENTERPRISE may retain certain materials for administrative and other reasons. 

Disclaimer of Warranty and Limitation of Liability

The Service, the Site and all related products and services provided by EXZA TRADE ENTERPRISE “as is” with no warranties whatsoever. All express, implied and statutory warranties, including, without limitation, the warranties of merchantability, fitness for a particular purpose, and non-infringement, are expressly disclaimed to the fullest extent permitted by law. EXZA TRADE ENTERPRISE disclaim any warranties for the security, reliability, timeliness, and performance of this Service. EXZA TRADE ENTERPRISE will not be liable to you, and you will waive any claims you may have against EXZA TRADE ENTERPRISE in respect of any loss, whether direct or indirect, or whether foreseeable or not suffered by you arising out of EXZA TRADE ENTERPRISE's negligence. 

EXZA TRADE ENTERPRISE do not warrant the security of information transmitted by or to you and may be accessed by unauthorized third parties purporting and/or disclosed by any officers, employees or agents of EXZA TRADE ENTERPRISE to third parties purporting to be you or purporting to act under your authority. You agree not to hold EXZA TRADE ENTERPRISE liable in any way for any loss whether direct or indirect suffered or incurred by you as a result of such access or disclosure. 

EXZA TRADE ENTERPRISE liability in any event to you howsoever arising in respect of the supply of the Service to you shall in no circumstances exceed the value of the Service supplied to you. EXZA TRADE ENTERPRISE shall in no circumstances be liable to you for any damages, including any lost profits, lost savings or any direct, indirect, incidental, consequential, special, exemplary, and punitive damages resulting from the use or provision of the Service, the Site and all related products and services, even if EXZA TRADE ENTERPRISE has been advised of the possibility of such damages.

Indemnity

You agree to indemnify and hold harmless EXZA TRADE ENTERPRISE, their successors, assignees, subsidiaries, affiliates, licensees and sublicensees, and their respective officers, directors, agents and employees, from and against any action, suit, claim, damages, liability, costs, and expenses, arising from: 

(a) your use of the Site or the Service;

(b) your violation of this Membership Agreement;

(c) your violation of third party rights;

(d) your violation or infringement of a third party's copyright, trade mark, trade secret, patent, or other intellectual property rights; or

(e) any libelous or unlawful material contained in your user account

Force Majeure

Without prejudice to the provisions of these Terms and Conditions limiting or disclaiming liability, EXZA TRADE ENTERPRISE are not liable for any delay or failure in performance resulting directly or indirectly from causes beyond its reasonable control, including, without limitation, failure of the internet, power failure, failure of computer, telecommunication or other equipment, strikes, labor disputes, riots, insurrections, civil disturbances, shortage of labor or materials, fires, floods, storms, explosions, act of God, war, governmental actions, orders of domestic or foreign courts, non-performance of third parties.

EXZA TRADE ENTERPRISE has a firm commitment to safeguarding your privacy. Please review EXZA TRADE ENTERPRISE's privacy statement. The terms of EXZA TRADE ENTERPRISE's privacy policy are incorporated into, and considered as part of, these terms and conditions.

Notices; Question

All notices from you to EXZA TRADE ENTERPRISE shall be in writing, and shall be made or delivered to EXZA TRADE ENTERPRISE via email or conventional mail.

Applicable Laws and Jurisdiction

This Membership Agreement and terms and conditions shall be governed by and construed in accordance with the laws of Malaysia. Any disputes arising under or in connection with these terms and conditions shall be subjected to the jurisdiction of the Malaysian Courts.

Assignment

This Membership Agreement shall not be assigned by you whether voluntarily or involuntarily or by operation of law, in whole or in part, to any party without the prior written consent of EXZA TRADE ENTERPRISE. No such assignment by you howsoever occuring shall relieve your obligations under this Membership Agreement.

Severability

In the event that any of the terms, conditions or provision contained in this Membership Agreement shall be determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision shall to that extent be severed from the remaining body of this Membership Agreement which shall continue to be valid and enforceable to the fullest extent permitted by law.
